Please read these terms carefully before using Ferrywell's services or this website. By booking an appointment, submitting an enquiry, or using our website, you agree to be bound by these terms. If you do not agree, please do not use our services or website.
1. Definitions
- "Ferrywell", "We", "Us", "Our" refers to Ferrywell, a registered business in Malaysia, operating from 61 Jalan Padungan, 93100 Kuching, Sarawak.
- "Service" means any of the three engagements offered: Statement Reading Session, Crossing File Assembly, or Extended Coordination Retainer, as described in the written scope provided before each engagement.
- "Client", "You", "Your" means the individual who books, attends, or makes an enquiry about a Service.
- "Scope Summary" means the written description of the Service, deliverables, fee, and payment terms sent by email before the engagement begins.
- "Agreement" means these Terms and Conditions together with the Scope Summary for a particular engagement.
2. Acceptance of Terms
These terms apply when you:
- Submit an enquiry via this website or by telephone or email.
- Book and attend an appointment.
- Make payment for a Service.
You must be at least 18 years old and legally capable of entering into a binding agreement under Malaysian law. If you are attending on behalf of another person (e.g. an elderly parent), you confirm that you have authority to act on their behalf and that the personal data you provide about them may be handled as described in our Privacy Policy.
3. Service Description
Ferrywell provides the following services:
- Statement Reading Session (RM 490): A ninety-minute educational session explaining the general structure of retirement and provident fund statements. No personal figures are interpreted. No advice is given.
- Crossing File Assembly (RM 1,780): Clerical organisation of your retirement documents into a single portable file over two appointments across four weeks. Includes a gap list, contents page, and digital mirror copy.
- Extended Coordination Retainer (RM 4,150 over 6 months): A six-month administrative support retainer maintaining a correspondence register, reply calendar, and neutral chronology. Ends with a bound handover pack.
Services are delivered at 61 Jalan Padungan, 93100 Kuching, Sarawak, during office hours. Services are available primarily to residents of Sarawak and Sabah. Requests from other regions of Malaysia may be considered on a case-by-case basis.
4. Client Responsibilities
- You are responsible for bringing the documents described in the Scope Summary to each appointment. Ferrywell cannot be held responsible for gaps in your file arising from documents not provided.
- You confirm that any documents you bring belong to you or that you have authority to share them with us for the purposes of the engagement.
- You agree not to use any output from our services (including the gap list, file, or handover pack) for any purpose prohibited by Malaysian law.
- You agree to treat Scope Summaries and any internal process notes shared with you as confidential.
5. Payment Terms
- Statement Reading Session: RM 490, paid in full before the appointment date.
- File Assembly: RM 1,780 — RM 890 at the first appointment, RM 890 at the second appointment.
- Coordination Retainer: RM 4,150 — billed monthly in six equal portions of RM 691.67. The first portion is due before the retainer begins.
All fees are in Malaysian Ringgit (MYR). Payment is accepted by bank transfer or online banking to the Ferrywell business account. A receipt will be issued by email within two business days of cleared payment.
Cancellation and Refunds: If you cancel a Statement Reading Session more than 48 hours before the appointment, the full fee will be refunded. Cancellations within 48 hours are non-refundable. For File Assembly, the first instalment is non-refundable once the first appointment has taken place. For the Coordination Retainer, you may give 30 days' written notice to terminate; completed months are non-refundable, and the next month's portion due will not be charged after the notice period.
6. Intellectual Property
All materials produced by Ferrywell — including annotated sample statements, glossaries, gap list templates, and the handover pack format — remain the intellectual property of Ferrywell. The copies provided to you are for your personal use only. You may not reproduce, distribute, or sell them without written consent from Ferrywell.
7. Disclaimers
Ferrywell provides clerical organisation, document support, and general educational information only. Specifically:
- We do not provide financial planning, investment, legal, or tax advice.
- We do not interpret personal financial figures or entitlements.
- We do not represent you before any government body, institution, or authority.
- The deliverables we produce (files, registers, packs) are organisational tools, not professional opinions or recommendations.
- The accuracy of any information in your file depends on the documents you provide to us. We do not verify the accuracy of source documents.
8. Limitation of Liability
To the fullest extent permitted by Malaysian law, Ferrywell's liability to you for any claim arising out of or in connection with a Service is limited to the fee paid by you for that specific engagement.
We are not liable for indirect, consequential, or special losses, including loss of income, financial loss, or decisions made based on the output of our services. We are not responsible for errors or omissions in documents provided to us by you or by third parties.
Nothing in these terms excludes liability for death or personal injury caused by negligence, or for fraud.
9. Indemnification
You agree to indemnify and hold Ferrywell harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these terms, your misuse of our services, or any inaccurate or unauthorised documents provided to us.
10. Termination
Either party may terminate an ongoing engagement by giving written notice. For the Coordination Retainer, the client must give 30 days' written notice. Ferrywell may terminate an engagement immediately if the client acts in breach of these terms or if circumstances arise that make it impracticable to continue. On termination, Ferrywell will return or delete all client documents within 5 business days. Sections 6, 7, 8, 9, and 11 survive termination.
11. Dispute Resolution and Governing Law
These terms are governed by the laws of Malaysia. In the event of a dispute, the parties will first attempt to resolve it informally by written correspondence. If the dispute is not resolved within 30 days, it will be referred to mediation under the auspices of the Malaysian Mediation Centre (MMC) before any court proceedings are commenced. Any proceedings that do proceed will be heard in the courts of Sarawak.
12. General Provisions
- Entire Agreement: These terms and the Scope Summary constitute the entire agreement between the parties for the relevant engagement.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
- No Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these terms without written consent. Ferrywell may assign its obligations to a suitably qualified successor.
- Notices: Written notices may be sent by email to [email protected] or by post to 61 Jalan Padungan, 93100 Kuching, Sarawak.
13. Changes to These Terms
We may update these terms from time to time. When we do, we will update the "Last Updated" date. If you are an active client when changes are made, we will notify you by email. Continued use of our services after the effective date constitutes acceptance of the updated terms.
